These Terms of Service (“Terms”) govern the provision of services by RecoverWise (“we”, “us”, “our”) to you (“the Client”, “you”). By purchasing or using any of our services, you confirm that you have read, understood, and agreed to these Terms.
1. Nature of Our Services
1.1 We provide administrative, document-based, and informational support to assist businesses with managing overdue invoices and pre-legal debt recovery processes.
1.2 Our services are not debt collection services, and we do not act as debt collectors, enforcement agents, or legal representatives.
1.3 We do not provide legal advice, financial advice, or regulated debt recovery services.
1.4 All actions taken using our templates, guidance, or administrative support are undertaken by you and under your instruction.
2. Scope of Services by Tier
Tier 1 – Debt Recovery Starter Kit (£49)
Includes self-service templates, guides, and example wording to enable you to manage your own debt recovery process.
No personalisation, case management, or ongoing support is included.
Tier 2 – Assisted Debt Recovery Toolkit (£119)
Includes everything in Tier 1, plus:
- A personalised Letter Before Action (LBA) prepared using information you provide
- Email-based guidance on next steps and options
- An example timeline tracker
Support is informational and administrative only. All decisions and communications remain your responsibility.
Tier 3 – Full-Service Business Debt Admin Support (£179 per case)
B2B only.
Includes full administrative support for a single business-to-business debt case up to (but excluding) enforcement.
This includes:
- Preparation and branding of letters
- Administrative tracking of timelines
- Scheduling of reminders
- Optional guidance relating to Money Claim Online (MCOL) and post-MCOL processes (informational only)
We do not:
- Contact debtors directly unless explicitly instructed
- Negotiate payment
- Accept payment on your behalf
- Issue court proceedings
Tier 4 – Business Recovery Partner (£399 quarterly subscription)
Ongoing administrative support for up to five (5) active B2B debt cases per quarter.
Includes priority administrative handling, progress tracking, and quarterly reviews.
Additional cases beyond the included limit are charged separately at the applicable rate.
3. Client Responsibilities
You agree that:
- You are responsible for the accuracy of all information provided
- You have the legal right to pursue the debts in question
- You will ensure all communications sent using our materials are accurate and lawful
- You remain responsible for all decisions, actions, and outcomes
We rely on the information you provide and are not responsible for errors arising from inaccurate or incomplete data.
4. Regulatory Position
4.1 We do not provide regulated debt collection services under UK law.
4.2 We do not act as an agent, representative, or intermediary between you and the debtor.
4.3 Our services are designed to support self-managed debt recovery.
5. Money Claim Online (MCOL) Guidance
Any guidance relating to MCOL or post-MCOL processes is provided for general informational purposes only.
We do not:
- File claims on your behalf
- Provide legal advice
- Represent you in court
You are solely responsible for any court action you choose to take.
6. Data Protection & Confidentiality
6.1 We process personal data in accordance with our Privacy Policy.
6.2 You confirm that you have the lawful right to share debtor information with us.
6.3 We act as a data processor where applicable, and you remain the data controller.
7. Fees, Billing & Refunds
7.1 All fees are payable in advance unless otherwise agreed.
7.2 Due to the nature of digital products and personalised services:
- Tier 1 products are non-refundable once purchased
- Tier 2 personalisation work begins immediately and is non-refundable once started
- Tier 3 and Tier 4 fees are non-refundable once administrative work has commenced
7.3 Subscription fees (Tier 4) are billed quarterly and renew automatically unless cancelled in accordance with these Terms.
8. Termination
8.1 You may terminate ongoing services with written notice.
8.2 We reserve the right to suspend or terminate services if:
- You breach these Terms
- You request activities outside our permitted scope
- Required information is not provided
9. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for loss of income, loss of business, or failed recovery
- Our total liability is limited to the fees paid for the relevant service
10. Changes to These Terms
We may update these Terms from time to time. The version in force at the time of purchase will apply.
11. Governing Law
These Terms are governed by the laws of England and Wales.
